KidsUp — Terms & Conditions

Please read these Terms and Conditions carefully. They contain important information about your legal rights, obligations, and remedies, including limitations on liability and the applicable jurisdiction for dispute resolution.

By downloading, installing, or using the KidsUp mobile application or any related services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Agreement to Terms

1.1 All access to and use of the KidsUp mobile application (“App”) and website at https://kidsup.world is governed by these Terms and our Privacy Policy.

1.2 By continuing to use the Services, you acknowledge that you have read and understood these Terms and agree to be bound by them.

1.3 You represent and warrant that you are at least 16 years old (or the age of majority in your jurisdiction) and have the legal capacity to agree to these Terms. If you are a minor, you must obtain parental or guardian consent before using the Services.

1.4 We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

2. Description of Services

KidsUp is a parenting app designed to support parents and guardians in the physical, emotional, and cognitive development of their children. The App provides evidence-based activities, expert-designed programs, and personalized recommendations developed by psychologists, speech therapists, and educators.

KidsUp does not provide medical, psychological, therapeutic, or clinical advice. All content in the App is for informational and educational purposes only. Always consult a qualified healthcare professional for medical or clinical concerns.

3. Account Registration

3.1 To access certain features, you must create an account. You agree to provide accurate and complete information and to keep it up to date.

3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.3 Notify us immediately at info@kidsup.world if you suspect unauthorized use of your account.

3.4 We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

4. Use of the Services

4.1 Permitted Use

You may use the Services solely for lawful, personal, non-commercial purposes in accordance with these Terms.

4.2 Prohibited Conduct

You must not:

  • Use the Services in any manner that violates applicable local, national, or international laws or regulations;
  • Access, tamper with, or use non-public areas of the App or its underlying infrastructure;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code or algorithms of the App;
  • Modify, adapt, translate, or create derivative works based on the App without our written permission;
  • Distribute, sublicense, sell, or transfer access to the Services to third parties;
  • Upload or transmit harmful, unlawful, defamatory, discriminatory, obscene, or otherwise objectionable content;
  • Interfere with or disrupt the integrity or performance of the Services or servers;
  • Collect data about other users without their consent;
  • Use the Services for commercial purposes, advertising, or spam.

5. Subscriptions and Payment

5.1 KidsUp offers premium features through paid subscription plans (“Subscription”). Subscription details, pricing, and available plans are displayed within the App.

5.2 Subscriptions may be purchased through the App via the Apple App Store or Google Play Store, or directly through our website.

5.3 By purchasing a Subscription, you authorize us (or the applicable app store) to charge the applicable fees to your chosen payment method.

5.4 Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your Subscription in your account settings or through the app store where you purchased it.

5.5 Pricing may vary by region and is subject to applicable taxes. We reserve the right to change pricing at any time, with reasonable advance notice.

5.6 All payments are non-refundable except as required by applicable law or as expressly set out in the refund policy of the relevant app store.

5.7 App Store Payments

If you purchase through Apple App Store or Google Play, your payment is subject to that platform’s terms. For refund requests on app store purchases, please contact the relevant app store’s support directly.

5.8 Free Trials

We may offer free trial periods. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

6. Intellectual Property

6.1 All content, features, and functionality of the Services — including text, graphics, images, audio, video, software, and AI-generated content — are owned by or licensed to KidsUp and are protected by applicable intellectual property laws worldwide.

6.2 You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes only.

6.3 You must not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Services without our express written consent.

6.4 You must not remove or alter any copyright, trademark, or other proprietary notices included in the Services.

7. User Content

7.1 You may have the ability to submit content through the Services (“User Content”). You retain ownership of your User Content, but by submitting it, you grant KidsUp a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display your User Content solely to operate and improve the Services.

7.2 You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third-party rights or applicable law.

8. AI Features Disclaimer

8.1 The Services may use artificial intelligence to generate personalized recommendations, activities, or content. AI-generated outputs are for informational and educational purposes only and do not constitute professional medical, psychological, or therapeutic advice.

8.2 AI systems may produce inaccurate or incomplete results. We do not warrant the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

8.3 Always consult qualified professionals for decisions affecting your child’s health, development, or wellbeing.

9. Disclaimers and Limitation of Liability

9.1 THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components. We are not liable for temporary unavailability or interruption of the Services.

9.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIDSUP AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.4 Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amounts you have paid to us in the 12 months preceding the claim, or USD 50, whichever is greater.

9.5 Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless KidsUp and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (i) your use of the Services; (ii) your violation of these Terms; (iii) your User Content; or (iv) your infringement of any third-party rights.

11. Third-Party Links and Services

The Services may contain links to third-party websites or integrate third-party services. We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

12. Termination

12.1 We may suspend or terminate your access to the Services at our discretion, at any time, with or without notice, if we believe you have violated these Terms or for any other reason.

12.2 You may close your account at any time by contacting us at support@kidsup.io.

12.3 Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, and limitation of liability) shall continue to apply.

13. Governing Law and Dispute Resolution

13.1 These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KidsUp is incorporated, without regard to conflict of law principles.

13.2 We encourage you to contact us first to resolve any concerns. If a dispute cannot be resolved informally, it shall be submitted to the competent courts in accordance with applicable law.

EEA / EU Residents: Nothing in these Terms limits your rights under applicable EU consumer protection laws, including your right to seek recourse in the courts of your country of residence.

14. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KidsUp regarding your use of the Services and supersede all prior agreements and understandings.
